Official Rules

Important: Please read these Official Rules before entering this online promotion (the "Contest"). By participating in the Contest, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.

NO PURCHASE, PAYMENT, OR FINANCIAL CONTRIBUTION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.

  1. Eligibility. To enter the Contest, you must be a natural person 18 years old or older, and a U.S. citizen or legal permanent resident of the U.S., currently resident in the U.S. or Puerto Rico. This Contest is offered only in the 50 United States and the District of Columbia. BUSINESSES, CORPORATIONS, REGISTERED FEDERAL LOBBYISTS, REGISTERED FOREIGN AGENTS, FEDERAL POLITICAL ACTION COMMITTEES, NATIONAL BANKS, FEDERAL CONTRACTORS, LABOR ORGANIZATIONS OR OTHER ENTITIES ARE NOT ELIGIBLE TO ENTER OR WIN A PRIZE, NOR MAY ANY INDIVIDUAL ENTER ON BEHALF OF ANY SUCH ENTITIES. IF YOU DO NOT MEET ANY OF THESE REQUIREMENTS, OR ANY OTHER ELIGIBILITY REQUIREMENTS IN THESE OFFICIAL RULES, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND COMMITTEE FOR CHARLOTTE 2012 ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU.

    PURCHASE, PAYMENT OR FINANCIAL CONTRIBUTION WILL NOT INCREASE ODDS OF WINNING. THIS CONTEST IS VOID WHERE PROHIBITED.

    Directors, officers, employees of, and consultants, professional advisors and contractors to, Committee for Charlotte 2012 Inc. (“Sponsor”) New American City, Inc. (“NAC”) , 2012 Democratic National Convention Committee, Inc. (“DNCC”) and any of their respective affiliate committees and immediate families of each, are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply.

  2. How to Enter.
    Participants may enter as follows:

    • The poster MUST incorporate the Official 2012 Democratic Convention logo in the design
    • Poster should incorporate one of the following themes:
    --Americans Coming Together
    --Building a Better Future
    --Opportunity and Empowerment

    • The poster MUST incorporate the Official 2012 Democratic Convention logo in the design

    • The poster cannot refer to any elected official or candidate for office, or promote or oppose any political party

    • Posters may include elements that are graphic, typographic, illustrated, collaged and/or include original photography created by the participant

    • Poster must be capable of reproduction by litho, digital or silk screen print

    • Poster in .PDF or .JPG format must be sent to poster@clt2012.com at or before 11:59 p.m. Eastern Standard Time December 31, 2011. No entries will be accepted after that time. Information requested on the submission form must be filled in.

    Entries received by facsimile or other means not expressly permitted in these Official Rules will not be considered. All text associated with the Entry Materials must be in the English language. All requested information and material must be provided for your entry to be valid. Entries submitted to Sponsor will not be returned to entrants. Failure to submit all required information in the manner required in these Official Rules and/or any entry or contribution form may result in disqualification.

    You must be the sole author and copyright owner of your entry or have permission, via license or otherwise, to use or incorporate those portions of your entry—video, still photographs,, language taken from books or articles—that was created or authored by, or is owned by, somebody else besides yourself. Images, music and other works in the public domain may be used in entries. But any use, in your entry, of any work that is not in the public domain and that infringes on the rights of any third party is forbidden. By entering this Contest, you agree to indemnify and hold the Sponsor, NAC and the DNCC, their officers, directors and employees, harmless from and against all costs, damages, loss and other liability (including reasonable attorneys fees) arising from any claim based on infringement of copyright or other intellectual property rights belonging to or which may be asserted by or on behalf of a third party.

  3. Selection of Winner. :

    On or before January 8, 2012, a panel of Sponsor staff, selected by Sponsor in its sole discretion (the “Judging Panel”), will evaluate all entries and select from eligible entries what the panel determines to be the best entries (not to exceed twenty) based on the following criteria:
    • The most apt, creative, original and interesting Poster;)
    • Incorporation of one of the three (3) themes: 1) American coming together 2) Building a better future 3) Opportunity and Empowerment
    • Appropriateness of tone;
    • Quality of workmanship
    • Reproducibility

    Beginning on or about January 16, 2012, the top entries selected (“Finalists”) will be posted online at www.charlottein2012.com/posterContest. Members of the public will be invited to vote to choose the best entry from among the finalists. All votes must be cast prior to 11:59 p.m. on January 30, 2012. .

    Sponsor will separately average (a) public voter scores and (b) scores assigned to the Finalists by the Judging Panel. The average public voter and average Judging Panel scores will be considered on a weighted basis to calculate the final score for each Finalist poster. In calculating the final score, averaged scores for each Finalist Poster will be weighted as follows: The public voter average will count as forty-five percent (45%), and the Judging Panel average will count as fifty-five percent (55%), of the overall score.

    The Finalist with the highest score will be declared the winner.

    In determining Finalists and the winner, Sponsor reserves the right to disqualify and remove from consideration any entry which, in Sponsor’s sole discretion and judgment, is inappropriate, offensive, defamatory or demeaning to the Sponsor’s reputation or goodwill or is otherwise not in the best interests of the Sponsor, NAC, or the DNCC.

    Winner will be notified by phone or e-mail by February 29, 2012. To claim the prize, the winner should follow the instructions and comply with the conditions contained in his/her notification.

  4. Prizes .

    (a) The individual who submitted the winning entry will receive:

    (1) A framed print of his/her poster (2) A limited edition of the poster will be offered for sale in the Committee for Charlotte online store in which Convention-themed merchandise is offered. The sales price will be determined by Sponsor in its sole and absolute discretion. The winner will receive $1 from the proceeds of each copy of the poster sold and paid for.

    (b) Odds of winning a prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF WINNER. All prizes will be awarded.

    (c) The winner will be required to sign an affidavit and release in a form determined by Sponsor. The prize may be forfeited and awarded to an alternative winner if the winner affidavit and release is not returned within three (3) days after being sent to winner or if two (2) attempts to contact winner by phone and/or e-mail are not successful. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

    (d) In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

  5. Grant of Licenses.

    By entering the Contest and submitting your entry, you agree that you are granting to each of the Sponsor, NAC and DNCC a non-exclusive, worldwide, royalty-free license to copy, reproduce, publicly display and publicly perform the entry; to perform or display the entry publicly at the 2012 Democratic National Convention, on the Sponsor’s website, on the DNCC’s website, over the Internet, and/or by any other means of display and/or communication whatsoever; to modify the entry and to publicly display and perform the entry as modified; to incorporate into the entry one or more collective works; to distribute copies of, display publicly, perform publicly and perform publicly by means of a visual, graphic or audiovisual transmission the entry included as incorporated in collective works and to reproduce the entry as incorporated in the collective works; and to create and reproduce derivative works based upon the entry or a substantial portion of the entry without attribution or prior permission.

    Acceptance of designation of your entry as a semi-finalist, finalist or winner constitutes permission for Sponsor, NAC and/or DNCC to use your name, hometown (including state) and/or your likeness for purposes of promotion, communications and other noncommercial purposes, without further compensation to you or further permission from you.

  6. Winner List; Rules Request.

    Winner List; Rules Request. For a copy of the winner list, send a stamped, self-addressed, business-size envelope after December 31, 2011 and before December 31, 2012 to Sponsor at the address listed below, Attn: "Committee for Charlotte 2012 – Poster Contest”. To obtain a copy of these Official Rules, visit www.charlottein2012.com or send a stamped, self-addressed business-size envelope to Sponsor at the address listed below, Attn: "Committee for Charlotte 2012- Poster Contest" Rules Request. Residents of VT may omit return postage.

  7. General Terms and Conditions.

    (a) By participating in the Contest, you agree that the Sponsor, DNCC and NAC, their officers, employees, consultants and agents (the “Released Parties”), shall not be responsible or liable for, and shall be released and held harmless from (i) telephone, electronic, hardware or software program, network Internet or computer malfunctions or failures of any kind; (ii) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted; (iii) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from your participation in the Contest or acceptance of designation as a finalist or winner, or arising from or based on the use, display or reproduction of your entry by Sponsor or DNCC; or arising from claims base on publicity rights, defamation or invasion of privacy. By entering the Contest, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory

    (b) By entering the Contest, you consent to being placed on an e-mail mailing list to receive information from Sponsor and for other purposes in accordance with Sponsor's Privacy Policy, Disclaimer and Release.

    (c) The Contest and these Official Rules will be governed, construed and interpreted under the laws of North Carolina without regard to its or any other jurisdiction's choice of law provisions. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned.

    (d) Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Contest, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
